Terms of Service

Welcome to Applied Compute! Applied Compute builds Specific Intelligence — purpose-built systems trained for specific work at specific companies. We help organizations unlock their own data, use it to train proprietary models, and deploy them as an agent workforce that learns, improves, and delivers measurable business impact. Our mission is to turn data moats into model moats — giving companies not just models, but capable digital teammates that work alongside their human counterparts. We have created these Terms of Service ("Terms") to govern the relationship between Applied Compute ("Applied Compute", "we" and "our") and the entity or person ("Customer", "you", "your") when you visit our website www.appliedcompute.com or using any of our services (collectively, the "Services").

Together, these Terms and our Privacy Policy form the Agreement ("Agreement") that governs your use of our Services. By using our Services, you agree to this Agreement. If we update these Terms, we'll post a new version here with a revised "Last Updated" date. Continuing to use the Services means you accept the new Terms.

1. Access to the Services

1.1 License to Use: Applied Compute grants you a limited, non-exclusive right to access and use the Services in compliance with these Terms.

1.2 Service Updates & Availability: We may update, enhance, or discontinue parts of the Services. While we strive for stability, we make no guarantees of uptime or reliability. Maintenance or technical issues may cause temporary downtime, but we'll work to restore access promptly.

1.3 Compliance and Service Performance: Applied Compute may review usage to ensure compliance and improve stability and performance.

2. Use of Services

2.1 Account Creation: You must create login credentials. We may refuse or revoke access if credentials are inappropriate.

2.2 Account Security: You are responsible for keeping your credentials safe and notifying us of any unauthorized access.

2.3 Age Requirements: You must be at least 13 years old and meet the minimum age of digital consent in your country.

2.4 Use Restrictions: You may not misuse the Services, including violating laws, reverse engineering, infringing rights, introducing malware, or engaging in fraud. We may suspend or terminate access for violations.

3. Term and Account Termination

The Agreement remains active until your use ends or is terminated. Applied Compute may suspend or terminate access at any time for violations. Subscription fees are non-refundable, and you may not re-register under a false or alternate identity.

4. Payment and Billing

You agree to provide accurate billing information and authorize automatic recurring payments until cancellation. Payments are non-refundable once a billing cycle starts. We may use third-party payment processors whose terms will govern payment handling.

5. Intellectual Property

5.1 Our IP: Applied Compute owns all rights to the Services and related data. You retain ownership of your own data and receive a limited, non-sublicensable license to use the Services.

5.2 Model Licenses: Some models or tools may have their own terms. You're responsible for compliance, and those terms will control if conflicts arise.

6. Warranties

6.1 Limited Warranty: We warrant that the Service will perform substantially as documented. Our obligation is limited to repair or replacement.

6.2 Disclaimers: Except as stated, the Services are provided "as-is" without warranties of any kind, including merchantability or fitness for a particular purpose.

7. Limitation of Liability

Applied Compute will not be liable for any indirect, incidental, or consequential damages, including lost revenue, profits, or data. Our total liability will not exceed the amount you paid to us in the twelve months before the first incident.

8. Indemnification

You agree to defend and indemnify Applied Compute and its affiliates from claims or losses arising from unauthorized use, breach of these Terms, or violation of laws.

9. Dispute Resolution

Disputes will be resolved through binding arbitration in San Francisco County, California, USA, in accordance with the American Arbitration Association's International Centre for Dispute Resolution Rules. You waive any right to a jury trial or class action.

10. Miscellaneous

  • Governing Law: California law governs this Agreement.
  • Force Majeure: We are not liable for failures caused by natural disasters or events beyond our control.
  • Partnership: This Agreement does not create a partnership or agency relationship.
  • Waiver and Severability: Failure to enforce a right is not a waiver. Invalid terms are severed without affecting the rest.
  • Assignment: You may not assign without consent; we may assign freely.
  • Survival: Payment, ownership, confidentiality, and limitation clauses survive termination.
  • Entire Agreement: This document supersedes prior agreements.
